Terms & Conditions

Effective date: 29 August 2026
Version: 2.0

1. About these Terms

1.1 These Terms and Conditions govern the provision of tutoring and related educational services by Merton Tuition Centre Ltd, referred to in these Terms as “MTC”, “we”, “us” or “our”.

1.2 The person enrolling a child or arranging services is referred to as “the Parent”, “you” or “your”. The child receiving the services is referred to as “the Student”.

1.3 By completing the online registration process, ticking the mandatory acceptance box and submitting an enrolment or payment request, you confirm that:

  • you are aged 18 or over;

  • you have parental responsibility for, or proper authority to act for, the Student;

  • the information you provide is accurate and complete;

  • you have read and agree to these Terms and Conditions;

  • you agree to the Parent Enrolment Agreement, where applicable; and

  • you agree to the processing of personal data in accordance with our Privacy Policy.

1.4 No paper or handwritten signature is required. Your electronic acceptance is intended to form a binding contract between you and MTC.

1.5 MTC will retain a record of your acceptance, including the date and time of acceptance and, where available, relevant electronic transaction details such as the IP address and registration record.

1.6 These Terms and Conditions should be read together with:

  • the Parent Enrolment Agreement, which is accepted through the online sign-up process;

  • the Privacy Policy available on our website; and

  • any specific information about the Student’s programme, timetable, fees or services provided to you before enrolment.

1.7 If there is a conflict between these Terms and Conditions and a specific written agreement expressly agreed between you and MTC, the specific agreement will apply to the extent of the conflict.

2. Our Services

2.1 MTC provides tutoring and educational support for students from primary school through to A-Level.

2.2 Our services may include:

  • KS2 and SATs preparation;

  • 10+ and 11+ entrance examination preparation;

  • Maths, English, Science, Verbal Reasoning and Non-Verbal Reasoning;

  • KS3 tuition;

  • GCSE tuition;

  • A-Level tuition;

  • small group tuition;

  • one-to-one tutoring;

  • mock examinations;

  • exam technique and timed practice;

  • intensive and holiday courses; and

  • related academic guidance and progress updates.

2.3 Services may be provided at MTC premises, partner venues, libraries, other agreed locations or online, depending on the programme selected.

2.4 Group sessions are generally designed to provide personalised support in a small-group environment. Class sizes, tutor numbers, session times and locations may vary depending on demand, availability, the Student’s programme and operational requirements.

2.5 We may allocate or change tutors where reasonably necessary, including because of tutor availability, illness, safeguarding considerations or the needs of the programme. We will aim to provide a suitable replacement and maintain continuity of service where reasonably possible.

2.6 MTC will provide the services with reasonable care and skill, in accordance with applicable consumer law.

2.7 Tutoring is intended to support the Student’s learning and preparation. However, MTC cannot guarantee a particular grade, examination result, school offer, entrance score or other academic outcome. Academic results may depend on factors outside MTC’s control, including the Student’s attendance, effort, ability, school teaching, examination conditions and the policies of schools or examination bodies.

3. Enrolment and Contract Formation

3.1 Before you submit an enrolment or payment request, we will provide or make available the main information about the relevant programme, including, where applicable:

  • the main characteristics of the service;

  • the applicable fees and payment arrangements;

  • the proposed timetable and location;

  • the expected duration or minimum commitment;

  • applicable cancellation arrangements; and

  • these Terms and Conditions and the Privacy Policy.

3.2 The contract is formed when MTC accepts your enrolment or payment request, or when MTC first provides the services, whichever occurs first.

3.3 MTC may decline an enrolment request where a suitable programme is unavailable, the information provided is incomplete or inaccurate, safeguarding concerns arise, or there is another reasonable operational or legal reason.

3.4 You must promptly notify MTC of any change to your contact details, emergency contact details, medical information, collection arrangements or other information relevant to the Student’s participation.

4. Fees and Payment

4.1 Fees are those displayed or communicated to you before enrolment, or otherwise confirmed by MTC.

4.2 Unless otherwise agreed, fees are payable monthly in advance by Direct Debit or recurring card payment.

4.3 Invoices and payment information may be made available through the MTC online portal or sent to the email address provided during registration.

4.4 You authorise MTC and its payment provider to take the agreed payments using the payment method supplied by you.

4.5 You must ensure that payment details remain valid and that sufficient funds are available when payment is due.

4.6 If a payment is missed or an account remains overdue, MTC may contact you to request payment and may suspend the Student’s services until the account is brought up to date. We will take reasonable steps to notify you before suspension where practicable.

4.7 Suspending services for non-payment does not automatically cancel any applicable notice period or outstanding payment obligation.

4.8 MTC will not charge more than the price agreed with you unless the change is permitted under these Terms and Conditions and you have been given any notice or cancellation right required by law.

5. Cancellation by the Parent

5.1 Your statutory consumer cancellation rights are set out in clause 6. They apply separately from the operational cancellation and credit arrangements in this clause.

5.2 Subject to clause 6, individual lessons must be cancelled at least 24 hours before the scheduled session to qualify for a credit.

5.3 A maximum of two lesson credits may be held on an account at any one time, with no more than one credit applying to each cancelled session. Credits expire 30 days after the relevant cancelled session unless MTC agrees otherwise.

5.4 Cancellations made less than 24 hours before the scheduled session will normally not qualify for a credit or refund. This does not affect any statutory rights you may have or any situation where MTC agrees that an exception is appropriate.

5.5 To cancel all services, you must provide at least one month’s written notice through the online portal or by email to info@mertontuition.com, unless a different notice period has been expressly agreed with you.

5.6 Unless otherwise agreed, fees remain payable during the notice period. MTC will not charge for sessions that MTC cancels and cannot reasonably rearrange or replace.

5.7 If you cancel part way through a payment period, MTC may apply the one-month notice period to the relevant payment cycle. We will not retain money for services that are not provided where a refund is required by law or expressly agreed by MTC.

5.8 MTC may ask you to contact us before cancelling so that we can try to resolve any issue, but you are not required to give a reason for exercising a legal cancellation right.

6. Statutory Cancellation Rights for Online Enrolment

6.1 If you enter into the contract online or otherwise as a distance contract, you may have a statutory right to cancel within 14 calendar days of entering into the contract, without giving a reason.

6.2 The statutory cancellation right may not apply, or may be affected, where:

  • the services have been fully performed during the cancellation period after you expressly requested us to begin performance and acknowledged that the right to cancel would be lost upon full performance; or

  • you requested that services begin during the cancellation period and the contract is cancelled before completion. In that case, you may be required to pay a proportionate amount for services supplied up to cancellation, where permitted by law.

6.3 To exercise a statutory cancellation right, you may email info@mertontuition.com with a clear statement that you wish to cancel. You may also use the model wording below, although you do not have to use it.

6.4 If you cancel under this clause, MTC will refund payments due to you within the period required by law, using the original payment method unless otherwise agreed.

6.5 The operational cancellation and credit arrangements in clause 5 apply after any applicable statutory cancellation period has ended, or where the statutory cancellation right does not apply.

7. MTC Cancellation and Changes to Sessions

7.1 MTC may cancel, rearrange or change a session where reasonably necessary, including because of tutor illness, venue availability, insufficient enrolment, technical problems, severe weather, public health concerns or other circumstances outside our reasonable control.

7.2 Where MTC cancels or materially changes a paid session, we will aim to offer a rearranged session, suitable alternative or credit. Where none is reasonably available, we will refund the relevant amount where appropriate.

7.3 MTC may withdraw a programme or change a timetable where reasonably necessary. We will provide reasonable advance notice where practicable and will consider a suitable alternative or refund for any prepaid service that cannot be provided.

8. Attendance and Behaviour

8.1 You must ensure that the Student attends sessions on time and has any required books, equipment or materials.

8.2 Parents are responsible for ensuring that the Student arrives safely at the agreed venue and is collected safely after the session, unless MTC has expressly agreed different arrangements in writing.

8.3 You must provide accurate information about any medical, educational, behavioural, accessibility or additional support needs that may affect the Student’s safety or participation.

8.4 The Student must behave respectfully towards tutors, helpers, other students, venue staff and MTC property.

8.5 Bullying, harassment, violence, threatening conduct, serious disruption, discrimination, deliberate damage or behaviour that creates a safeguarding or safety concern will not be accepted.

8.6 Where behaviour is disruptive or creates a risk to others, MTC may take reasonable steps, including contacting the Parent, requiring the Student to leave a session, suspending attendance or ending the services. We will consider the circumstances and the Student’s needs before taking action where practicable.

8.7 Where services are ended because of serious or repeated misconduct, MTC may retain fees relating to services already provided. This does not limit any statutory rights the Parent may have.

9. Safeguarding and Welfare

9.1 MTC takes reasonable steps to provide a safe and supportive learning environment for children and young people.

9.2 MTC maintains safeguarding procedures appropriate to its services and expects tutors, helpers and other relevant personnel to follow those procedures.

9.3 MTC may take reasonable safeguarding steps, including speaking with the Student, contacting the Parent, contacting an emergency contact, sharing information with relevant safeguarding professionals or contacting emergency services where necessary to protect the Student or another person.

9.4 You must provide:

  • at least one reliable emergency contact;

  • relevant medical, allergy and medication information;

  • information about additional support or communication needs;

  • authorised collection arrangements; and

  • any court order, parental responsibility information or other restriction relevant to the Student’s care.

9.5 MTC may refuse to release a Student to a person who is not authorised, appears unable to provide safe care or presents a safeguarding concern.

9.6 MTC cannot administer medication unless this has been separately agreed and appropriate arrangements have been made. Parents must not send a Student to a session where the Student is too unwell to participate safely or may pose an infection risk to others.

9.7 MTC may record and report safeguarding concerns to the appropriate authority where required or permitted by law. We may do so without prior parental consent where necessary to protect a child or another person.

10. Photographs, Video and Media

10.1 MTC will not use photographs, video or other identifiable media of the Student for publicity, marketing or social media without appropriate consent.

10.2 Any consent for publicity or marketing media will be requested separately and will not be a condition of enrolment or continued tutoring.

10.3 You may withdraw media consent at any time by contacting info@mertontuition.com. Withdrawal will not affect the lawfulness of use before withdrawal, and material already printed or distributed may not be capable of immediate recall.

10.4 MTC may use recordings or images for safeguarding, incident management, service administration or legal purposes where permitted or required by law. This is separate from optional publicity consent.

11. Data Protection and Privacy

11.1 Merton Tuition Centre Ltd is the data controller for personal data processed in connection with the provision and administration of its services.

11.2 MTC may process personal data relating to Parents, Students and emergency contacts for purposes including:

  • registering and managing the Student’s enrolment;

  • providing tutoring and communicating about sessions;

  • arranging timetables, venues and tutor allocation;

  • processing payments and managing accounts;

  • monitoring progress and providing parent updates;

  • maintaining attendance and safeguarding records;

  • responding to enquiries, complaints and incidents;

  • complying with legal and regulatory obligations;

  • establishing, exercising or defending legal claims; and

  • protecting the vital interests of a Student or another person in an emergency.

11.3 Depending on the purpose, MTC may rely on the following lawful bases under UK data protection law:

  • performance of a contract;

  • compliance with a legal obligation;

  • protection of vital interests;

  • MTC’s legitimate interests, where those interests are not overridden by the rights and interests of the individual; and

  • consent, where consent is the appropriate legal basis, including for optional marketing or publicity media.

11.4 Information about health, allergies, disability, additional support needs or other sensitive matters may constitute special category personal data. MTC will process such information only where an appropriate additional condition under UK data protection law applies, which may include explicit consent, the protection of vital interests or another lawful condition.

11.5 Children’s personal data receives additional protection. MTC will process it fairly, securely and only for appropriate purposes connected with education, administration, safeguarding and the operation of its services. Privacy information will be provided in a clear and accessible way, with particular care taken where the Student is young or may have difficulty understanding data processing.

11.6 MTC may share personal data with appropriate service providers and other recipients where necessary, including:

  • payment processors and banking providers;

  • online booking, account and communication platform providers;

  • tutors and helpers who need the information to provide the services;

  • venues or partner organisations where necessary for the relevant programme;

  • professional advisers, insurers and legal representatives;

  • emergency services, safeguarding authorities or regulators where required or permitted by law; and

  • public authorities where necessary to comply with a legal obligation.

11.7 MTC will not sell personal data. We will not share personal data for unrelated marketing purposes without an appropriate lawful basis and, where required, consent.

11.8 MTC will retain personal data only for as long as reasonably necessary for the purpose for which it was collected, to meet legal and regulatory requirements, or to establish, exercise or defend legal claims. Unless a longer period is required or justified:

  • enrolment, account and service records will normally be retained for up to six years after the end of the relevant relationship;

  • payment and financial records will normally be retained for the period required by applicable tax and accounting obligations;

  • safeguarding, incident and complaint records may be retained for longer where necessary to protect children, comply with legal obligations or manage potential claims; and

  • marketing consent records will be retained for as long as necessary to demonstrate consent and manage withdrawals.

11.9 Subject to legal exemptions and applicable conditions, individuals may have the right to:

  • access their personal data;

  • request correction of inaccurate or incomplete data;

  • request erasure of personal data;

  • request restriction of processing;

  • receive personal data in a portable format;

  • object to processing, including certain processing based on legitimate interests or direct marketing;

  • withdraw consent where processing is based on consent; and

  • complain to the Information Commissioner’s Office.

11.10 Requests about personal data should be sent to info@mertontuition.com. MTC may need to verify the identity and authority of a person making a request, particularly where the request concerns a child’s data.

11.11 Further information about how MTC collects, uses, stores and protects personal data is set out in the Privacy Policy on our website.

12. Teaching Materials and Intellectual Property

12.1 MTC or its licensors own the intellectual property rights in materials created or supplied by MTC, including worksheets, lesson plans, assessments, mock examinations, written content, presentations, recordings and other teaching resources.

12.2 MTC grants the Student a limited, personal, non-exclusive and non-transferable permission to use materials supplied as part of the services for the Student’s own educational and non-commercial purposes.

12.3 You and the Student must not copy, sell, publish, distribute, upload, share commercially, adapt or reproduce MTC materials without our prior written permission.

12.4 Students retain ownership of their original work, subject to any permission separately given to MTC to review, store or use that work for teaching, assessment, progress reporting, safeguarding or service administration.

13. Communications and Progress Updates

13.1 MTC may contact you using the email address, telephone number or other contact details provided during registration.

13.2 Communications may include:

  • timetable and venue information;

  • payment and account notices;

  • attendance matters;

  • safeguarding or welfare communications;

  • information about the Student’s progress;

  • service updates; and

  • responses to enquiries or complaints.

13.3 You must ensure that the contact details provided to MTC are accurate and monitored regularly.

13.4 Progress updates are intended to provide helpful information about the Student’s engagement and development. They are not formal school reports, guarantees of academic results or professional diagnoses.

13.5 Marketing communications will be sent only where permitted by law. You may opt out of marketing communications at any time.

14. Complaints

14.1 MTC aims to resolve concerns promptly and fairly. If you have a complaint, please contact info@mertontuition.com with:

  • the Parent’s name;

  • the Student’s name;

  • details of the concern;

  • the relevant date or session; and

  • the outcome you would like MTC to consider.

14.2 We may acknowledge a complaint within five working days and will aim to provide a substantive response within a reasonable period, depending on the complexity of the matter.

14.3 We may ask for further information, speak with relevant tutors or staff, review records and propose an appropriate resolution.

14.4 Making a complaint does not remove your obligation to pay undisputed fees, although MTC may agree to a temporary alternative arrangement while a complaint is being investigated.

14.5 Nothing in this complaints procedure prevents you from exercising any statutory right or seeking advice from an appropriate authority, including the Information Commissioner’s Office where the issue concerns data protection.

15. Liability

15.1 MTC will provide the services with reasonable care and skill and will take reasonable steps to maintain a safe learning environment.

15.2 Nothing in these Terms and Conditions excludes or limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • breach of any liability that cannot legally be excluded or limited; or

  • your statutory consumer rights.

15.3 Subject to clause 15.2, MTC will not be responsible for loss caused by matters outside its reasonable control, including school or examination board decisions, changes to examination arrangements, transport problems, the Student’s failure to attend or participate, or inaccurate information supplied by the Parent.

15.4 MTC is not responsible for the loss of or damage to personal belongings brought to a session unless caused by MTC’s negligence or another circumstance for which MTC is legally responsible.

15.5 Nothing in these Terms and Conditions prevents you from relying on rights or remedies available under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

16. Events Outside Our Reasonable Control

16.1 MTC will not be liable for delay or failure to provide services caused by events outside our reasonable control.

16.2 Such events may include serious illness, staff shortages, venue closure, utility failure, internet or technology failure, severe weather, fire, flood, epidemic, industrial action, government action, civil emergency or other circumstances that could not reasonably have been prevented.

16.3 Where an event outside our reasonable control affects a service, MTC will take reasonable steps to notify you and will consider rearrangement, an alternative service, credit or refund where appropriate.

17. Changes to These Terms

17.1 MTC may make non-material changes to these Terms and Conditions where reasonably necessary, including to improve clarity, reflect operational changes or correct errors.

17.2 MTC may make material changes where reasonably necessary, including to reflect changes in law, regulatory requirements, payment arrangements, safeguarding requirements, technology or the services provided.

17.3 We will give reasonable advance notice of any material change, normally by email or through the online portal, and will explain the main effect of the change.

17.4 If you do not accept a material change, you may cancel the affected services without penalty before the change takes effect by contacting info@mertontuition.com. We will refund any amount paid in advance for services that will not be provided because of the cancellation, where appropriate.

17.5 Changes will not retrospectively alter services already provided, payments already due or rights that have already accrued.

17.6 We will not use this clause to remove or restrict statutory consumer rights or to impose a material change without giving the notice and cancellation opportunity required by law.

18. Ending the Contract

18.1 You may end the contract in accordance with clauses 5 and 6.

18.2 MTC may end or suspend the contract immediately where reasonably necessary because:

  • fees remain unpaid after reasonable notice;

  • the Parent or Student seriously breaches these Terms;

  • there is serious misconduct, abuse, violence, harassment or a safeguarding concern;

  • continuing the services would create a risk to a Student, tutor, helper or other person;

  • information supplied during enrolment is materially inaccurate; or

  • MTC is no longer legally or reasonably able to provide the services.

18.3 Where appropriate, MTC will give reasonable notice and an opportunity to remedy a breach before ending or suspending services. This may not be possible where immediate action is required for safety, safeguarding or legal reasons.

18.4 Ending the contract does not affect rights and obligations that arose before the contract ended, including payment obligations for services already provided.

19. General Provisions

19.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

19.2 A failure or delay by MTC to enforce a provision does not mean that MTC has waived the right to enforce it later.

19.3 You may not transfer the contract or your rights under it to another person without MTC’s written consent. MTC may transfer its rights and obligations to another organisation where this does not reduce your legal rights and we notify you where required.

19.4 The contract is between you and MTC. No other person has the right to enforce it under the Contracts (Rights of Third Parties) Act 1999, except where the law provides otherwise.

19.5 These Terms and Conditions, the Parent Enrolment Agreement, the applicable programme information and the Privacy Policy form the relevant contractual and policy framework for the services.

20. Governing Law and Jurisdiction

20.1 These Terms and Conditions and any contract between you and MTC are governed by the law of England and Wales.

20.2 The courts of England and Wales will have jurisdiction in relation to any dispute or claim arising out of or in connection with the contract, subject to any mandatory legal right you may have to bring proceedings in another jurisdiction.
